Seizure of property and seizure of part of the property in the current legislation

Criminal Code Act No. 40/2009 Coll. distinguishes criminal sanctions into penalties and protective measures. This distinction is called dualism of criminal sanctions. Protective measures are broadly subdivided into protective measures restricting personal liberty and protective measures affecting property. These 'property protection measures' have long been represented by the protective measure of seizure of property under Section 101 of the Criminal Code, which was linked to similar protective measures in previous substantive criminal law. Amendment No. 55/2017 Coll. to the Criminal Procedure Code, in response to the so-called Confiscation Directive 2014/42/EU, introduced a new protective measure of seizure of part of the property pursuant to Section 102a of the Criminal Procedure Code. An alternative solution with significant doctrinal support was considered, including the creation of a special regulation for a more comprehensive solution to the confiscation issue and a more appropriate settlement with the principles contained in general criminal law. Presentation of exhibitions in state chateaux in Eastern Bohemia after Second Word War

The period after Second Word started the changes in many areas in Bohemia. The new era also affected castles and chateaux, whose onwer became the state. Their next progression was decided by Nacional Cultural Commission. This institution selected sights to be conserved as museums but many of them were chosen for use by schools, children's homes or as hotels. The topic of this thesis is post-war presentation at monuments in Eastern Bohemia. These are the castles of Náchod, Ratibořice, Opočno and Slatiňany which are not far from each other. Their post-war progression was very different. The thesis will focus on the history of these monuments, the firts years after war, the work of Nacional Cultura Commission, the sorting of equipment, the form of the first exhibitons, the introductory historical exhibitions, guide texts ane the presentation of installations from 1990 to the present. Verdugo in Bohemia in the second quarter of the 17th century

This bachelor thesis deals with the Spanish noble House of Verdugo, which came to the Kingdom of Bohemia after 1620 in the service of the Austrian Habsburgs as soldiers. After the defeat of the Bohemian Estates in the Battle of White Mountain Verdugos purchased the confiscated property in the north of Bohemia, which they held until 1695 when they moved to Silesia. The thesis aims to examine the House of Verdugo in the period between 1611 and 1639, and its three members - William, John and Francis. Furthermore, it attempts to place the noble house in the European and Spanish context.

Hence, the main focus lies on the topics such as the activity and agenda of ONV Strakonice and MNV Strakonice with regard to the personal and political structure of these authorities following the parliamentary elections in the spring of 1946 and the radical changes after the political coup on February 25th 1948. In this respect the thesis tracks the alterations in the distribution of political power in the region and offers a clear view of the transition from the unstable post- war democracy to the communistic dictatorship. This work shows history of the castle in Mnichovo Hradiště. It deals with history of the castle, but the main topic is what happened in 20. century. How the owners behave towards to the castle, what changed when the castle was confiscated. The work is based on archive material stored in the National archiv in Prag, Mnichovo Hradiště Municipal museum. It also works with the chroniclas of Mnichovo Hradiště, memories of citizens and handwirtten memories of the citizens. Used also contemporary local newspapers. Confiscation and the Allotment Procedure pursuant to Presidential Decrees in Czech Case Law

This thesis deals with the reflection of confiscation and the allotment procedure pursuant to presidential decrees in Czech case law. In numerous cases, the allotment procedure has still not been completed or persistent problems arise from it in the area of legal relations to immovables and their registration up to the present day. The thesis analyses and categorises relevant statutory and case law based upon the material criterion. The result is a set of clearly defined thematic groups of the most significant judgements covering the individual problems identified and an analysis of the stability of the case law or the lack thereof in the individual thematic groups particularly in relation to the principle of legal safeguard which - as this thesis argues - gradually becomes more and more important in relevant Czech case law.
Land reform during the First Republic

The topic of my thesis is "Land reform during the First Republic", which proceeded in our state from the year 1919 till the year 1935. The land reform contained an element of the confiscation and expropriation, so I integrated in the introduction of my thesis the explanation and short overview of process and history of these two institutes, which represent the most important intervention of the states to the landed property. After that I focused on the alterations of the lands, their history and importance. The main part of my thesis deals with the land reform, especially the preconditions and the reasons, why our state decided to carry out so important and forward change of the landed property and different conceptions and views of the political parties. The next part of my thesis is focused on the laws, which deal with main problems and issues of the land reform, and on the pursuance of the land reform in practice. I didn't miss out include in my thesis neither results of this reform nor the criticism and appreciation of this reform. In my opinion this reform poses important component of the coup and one of the most important tasks, which the new independent state had to fulfil to stabilize the internal situation in the land.
Nationalization and confiscation between 1945 and 1948

The diploma thesis deals primarily with the so-called first stage of the nationalization process in Czechoslovakia, which took place between 1945 - 1948, and the post-war confiscations of the same period, as well. The objective of the thesis is particularly to describe and analyze the then relevant legal regulations and place them adequately in the historical context. The content of the five thematic chapters is adapted to this topic. First, it attempts to define the basic concepts of nationalization, appropriation, socialization, expropriation and confiscation. Subsequently, it examines the basic historical roots of the concept of nationalization. It does so especially by comparing the approaches to proprietary rights through the prism of two dominant ideologies, namely liberalism and socialism. The core of the thesis consists of the nationalization and confiscation decrees themselves and the issues related. The National Institute of Administration was closely associated with this issue, as well. From the legislator's point of view, it was also necessary to distinguish which assets were to be confiscated and which, on the other hand, nationalized.
